From the New York State Unified Court System, Advisory Committee on Artificial Intelligence in the Courts.
Purpose and Scope
“This guide addresses the responsible use of artificial intelligence (AI) tools — particularly
generative AI tools — by attorneys in litigation and alternative dispute resolution. It draws on the
framework articulated by the New York Advisory Committee on Artificial Intelligence and the
Courts (Advisory Committee) and is designed to help practitioners understand both the legitimate
uses of generative AI in legal practice and the professional risks that arise from its misuse —
particularly the well-documented risk of AI-generated fabrications and errors in court filings.
The guidance below applies to litigators, transactional counsel preparing materials for filing, and
neutrals engaged in mediation and arbitration. It is not jurisdiction-specific in its core principles,
although it reflects the regulatory direction taken in New York. In addition, while this guide refers
to the use of AI technology by attorneys, and includes a discussion of duties owed by attorneys,
the information it provides on how AI works and how to use it responsibly is equally applicable to
parties representing themselves in court proceeding,”
