Judge Merchan’s Decision Clears Path for Trump’s Presidency, Despite Felony Conviction

President-elect Donald Trump is scheduled to be sentenced on January 10 for 34 counts of falsifying business records, just days before his inauguration on January 20. A judge ruled Friday, January 3, 2025, that Trump is unlikely to face jail time.

New York Supreme Court Justice Juan Merchan stated in his decision that he does not plan to impose a jail sentence. Instead, he intends to issue an “unconditional discharge,” a legal outcome in New York that involves no jail time, probation, or additional conditions.

This decision, which upholds Trump’s conviction, sets the stage for him to become the first individual with a felony conviction to serve as President of the United States.

The sentencing date coincides with a significant moment for Trump, as he is scheduled to attend memorial services in Washington on January 9 for former President Jimmy Carter, who passed away on December 29 at the age of 100. Trump will have the option to attend the sentencing in person at the Manhattan courthouse or participate remotely via video.
